These Terms of Service ("Terms") govern your access to and use of the Workel platform, including our website, applications, and related services (collectively, the "Service") provided by Workel, Inc. ("Workel", "we", "us", or "our"). By accessing or using the Service, you agree to be bound by these Terms.
By creating an account, accessing, or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you are using the Service on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms. If you do not agree to these Terms, you may not access or use the Service.
To use the Service, you must create an account by providing accurate and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account. You must be at least 16 years old to create an account. We reserve the right to suspend or terminate accounts that violate these Terms or that contain false or misleading information.

The Service, including all software, designs, text, graphics, logos, icons, and other content, is the property of Workel or its licensors and is protected by copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to access and use the Service for its intended purpose during the term of your subscription. This license does not include any right to modify, distribute, or create derivative works of the Service.
You retain all rights, title, and interest in the content you create, upload, or store within the Service ("Your Content"). By using the Service, you grant Workel a limited license to host, store, transmit, display, and distribute Your Content solely for the purpose of providing the Service to you. We will not access, use, or share Your Content except as necessary to provide the Service, comply with the law, or as described in our Privacy Policy. Upon account termination, you may export Your Content within 30 days, after which it may be permanently deleted.
We strive to maintain 99.9% uptime for the Service and provide a Service Level Agreement (SLA) for paid plans. This SLA does not cover scheduled maintenance (which we will announce with at least 24 hours' notice), force majeure events, or issues caused by third-party services. In the event of downtime exceeding our SLA commitment, eligible customers may request service credits as described in our SLA documentation. We reserve the right to modify, suspend, or discontinue any part of the Service with reasonable notice.
To the maximum extent permitted by applicable law, Workel and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, or goodwill, arising out of or in connection with your use of the Service. Our total aggregate liability for any claims arising out of or related to the Service shall not exceed the amounts you have paid to Workel in the twelve (12) months preceding the claim. This limitation applies regardless of the theory of liability, whether based in contract, tort, negligence, strict liability, or otherwise.
You may terminate your account at any time by contacting us or through your account settings. We may terminate or suspend your account immediately, without prior notice, if you breach these Terms or engage in conduct that we determine, in our sole discretion, is harmful to other users, us, or third parties. These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms shall be brought exclusively in the federal or state courts located in Delaware, and you consent to the personal jurisdiction of such courts. Any dispute arising out of or relating to these Terms that cannot be resolved through good-faith negotiation within 30 days shall be resolved through binding arbitration administered by the American Arbitration Association.
